1. About these terms
These Terms of Use ("Terms") govern your access to and use of the website at www.dmqglobal.com and any associated pages or subdomains (the "Site").
The Site is operated by DMQ Ventures Ltd ("DMQ", "we", "us", "our"), a company registered in England and Wales under company number 16524928.
By accessing or using the Site, you confirm that you accept these Terms and agree to be bound by them. If you do not agree to these Terms, you must not use the Site.
We recommend that you print or save a copy of these Terms for your records.
2. Our regulatory status
DMQ Ventures Ltd (FCA Reference Number: 1052653) is an Appointed Representative of Capital Alliance Partners Limited, which is authorised and regulated by the Financial Conduct Authority (the "FCA").
You can verify our status on the Financial Services Register at register.fca.org.uk.
Only those activities carried on by DMQ that fall within the scope of our appointed representative agreement with Capital Alliance Partners Limited are regulated activities. Not all of the services or activities described on the Site are necessarily regulated by the FCA, and certain investments referred to on the Site are unregulated. Where you are in doubt as to whether a particular service is regulated, please contact us.
3. Who this Site is intended for
The Site and its contents are directed only at persons who are:
- professional clients or eligible counterparties as defined in the FCA Handbook; and/or
- persons falling within the exemptions in the Financial Services and Markets Act 2000 (Financial Promotion) Order 2005 or the Financial Services and Markets Act 2000 (Promotion of Collective Investment Schemes) (Exemptions) Order 2001, including investment professionals, high net worth companies and unincorporated associations, certified high net worth individuals, certified sophisticated investors and self-certified sophisticated investors;
(together, "Relevant Persons").
The Site is not intended for, and must not be relied upon by, retail clients or members of the general public. Any investment or investment activity to which the content of the Site relates is available only to Relevant Persons and will be engaged in only with Relevant Persons. If you are not a Relevant Person, you should not act or rely on any information contained on the Site.
4. No offer, solicitation or advice
Nothing on the Site constitutes, or should be construed as:

In the event of any inconsistency between the Site and such documentation, the definitive documentation will prevail.

5. Investment risk warnings

10. Acceptable use
You agree not to:
- use the Site in any way that breaches applicable law or regulation, or for any unlawful or fraudulent purpose;
- attempt to gain unauthorised access to the Site, the server on which it is stored, or any connected server, computer or database;
- introduce any virus, trojan, worm, logic bomb or other material that is malicious or technologically harmful;
- carry out any denial-of-service or distributed denial-of-service attack;
- use any automated system (including scraping, robots or data-mining tools) to access, copy or monitor the Site or its content without our written consent;
- submit false, misleading or third-party personal information through any form on the Site; or

We may report any breach of this section to the relevant law enforcement authorities and will cooperate with them, including by disclosing your identity. We may suspend or terminate your access to the Site at any time, without notice, for any breach of these Terms.

Any information you submit through the Site's contact form or by email to us is submitted on a non-confidential basis unless we have separately agreed otherwise in writing (for example, under a signed non-disclosure agreement).
Please do not send us confidential business plans, trade secrets, or unsolicited proprietary information through the Site. Submitting information to us does not create any advisory, fiduciary, client or other relationship between you and DMQ, and does not oblige us to respond, to consider any opportunity, or to refrain from pursuing similar opportunities.
We may consider, evaluate or pursue opportunities that are similar to or competitive with any idea or business submitted to us, and we accept no liability for doing so.
Internet communications are not guaranteed to be secure or error-free. We are not responsible for any loss or damage arising from information sent to or by us over the internet.
12. Third-party links
The Site may contain links to third-party websites and resources. These links are provided for your convenience only and do not signify our endorsement of those sites or their contents. We have no control over, and accept no responsibility for, the content of third-party sites or any loss or damage arising from your use of them.
13. Availability of the Site
We do not guarantee that the Site, or any content on it, will always be available, uninterrupted, or free from errors or viruses. Access is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of the Site without notice and without liability.
You are responsible for making all arrangements necessary for you to access the Site, including your own internet connection and appropriate security and virus protection.
14. Limitation of liability
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for any breach of duty owed under the FCA rules where such exclusion would be prohibited, or for any other liability that cannot lawfully be excluded or limited.
Subject to the paragraph above, and to the fullest extent permitted by law:
- we exclude all conditions, warranties, representations and other terms that might otherwise be implied into these Terms by statute, common law or otherwise;
- we will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty or otherwise, arising under or in connection with use of, inability to use, or reliance on the Site or any content on it, including any loss of profits, loss of business, business interruption, loss of anticipated savings, loss of data, loss of goodwill, or any indirect or consequential loss; and
- we will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your equipment as a result of your use of the Site or of any site linked to it.
If you are a business user, the Site is provided for business purposes only and we have no liability to you for any loss suffered in connection with your business.
15. Indemnity
You agree to indemnify and hold harmless DMQ, its directors, officers, employees and agents from and against all claims, liabilities, losses, damages, costs and expenses (including reasonable legal fees) arising out of or in connection with your breach of these Terms or your misuse of the Site.
16. Privacy and cookies
Your use of the Site is also governed by our Privacy Policy and our use of cookies is described in that policy. Please read it to understand how we collect and use your personal data.
17. Complaints
If you have a complaint about DMQ or our services, please contact us at the contact form on our website. Complaints relating to regulated activities are handled in accordance with the FCA's DISP rules by our principal firm, Capital Alliance Partners Limited.
Depending on your classification and the nature of your complaint, you may be eligible to refer the matter to the Financial Ombudsman Service (www.financial-ombudsman.org.uk). Eligibility is generally limited to consumers, micro-enterprises and certain small businesses and charities; most professional clients and eligible counterparties are not eligible. You may also be eligible for compensation under the Financial Services Compensation Scheme (www.fscs.org.uk) in certain circumstances.
18. Changes to these Terms
We may amend these Terms at any time by posting a revised version on the Site. The version in force is the one published on the Site at the time you access it, and the "Last updated" date above indicates when it was last changed. Please check this page periodically. Continued use of the Site after a change constitutes acceptance of the revised Terms.
19. General
Severability. If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be severed and the remaining provisions will continue in full force.
No waiver. Our failure or delay in enforcing any provision of these Terms will not constitute a waiver of that provision or of any other.
Third party rights. A person who is not a party to these Terms has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any of its provisions.
Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and us in relation to your use of the Site.
20. Governing law and jurisdiction
These Terms, their subject matter and their formation (and any non-contractual disputes or claims arising out of or in connection with them) are governed by the laws of England and Wales. You and we agree that the courts of England and Wales will have exclusive jurisdiction, save that we retain the right to bring proceedings against you in the courts of the country in which you are resident or established.
